Under the CLA
HE Photocopy and Scanning Licence, adhoc copying
for
course readers or handouts from CLA
Licenced material, is permitted (within licence
limitations) without further copyright fees being incurred. The University must own an original copy of the publication, or a British Library Copyright Fee Paid (CFP) copy.
Full bibliographic reference, details
of origin and date, must always be attached to
copies made or in the case of course
readers, within a bibliography or reference list.
Photocopy Blanket Licence Limitations
The general Blanket Licence copying
limitations are:

work is regarded as a work in itself, and may
not be copied in its entirety under
Section 29 of the Act, but may be copied under
the CLA Licence as long as a maximum
of 10 pages is not exceeded.
Where the above limitations
are exceeded, copyright
clearance will need to be
sought from the Publisher/Copyright
Owner (see Copyright
Clearance Procedure).
Permissions received from
publishers are non exclusive and usually limited to a specific
academic year, module and number of students.

Electronic Reading Material for OASISplus
The CLA HE Photocopy and Scanning Licence, permits digitising/scanning of material from all CLA Licenced materials owned by the university, or a British Library Copyright Fee Paid (CFP) copy, for electronic delivery to students of designated courses/modules over a secure network, providing the licence limitations and requirements are adhered to.
The Limitations are:

The main requirements of the CLA Scanning Licence are;
- Scanning must be performed by a designated person (no limit on how many persons as posts, not names are designated).
- Electronic copies must retain the integrity and appearance of the original document.
- If an electronic version of the required item is commercially available, a valid reason for our wish to scan must be given to the CLA. (Budgetary constraints is an acceptable reason)
- Each copy of a document must have a CLA Copyright Notice attached .
- Scanned material must be accessible only to students registered on the specified module/s and affiliated staff via a secure network (OASISplus).
- All scanning must be reported the Copyright Officer in order to collate the information from all areas, into one main report to be submitted to the CLA. NB. This includes material inserted into Powerpoint slides subsequently uploaded onto OASISplus.
- Scanned items no longer required must be removed from OASISplus and the CLA scanning report.
- The CLA Compliance Unit will require access to OASISplus modules for auditing purposes.
CLA and BLHESS
Under the CLA Scanning licence, digitised articles can be ordered from the British Library HE Scanning Service for OASISplus course readings only, via the Learning Resources Inter Library Loans Service. The articles will be received as unencrypted PDF files to which CLA Copyright Notices will need to be attached before inclusion in the OASISplus modules.
For all materials not licenced by the CLA or exceeding the licence limitations, Copyright clearance must be obtained from the Publisher/Copyright Owner unless specific permission has already granted.
